Terms of Service

These terms are between you and GoldenBerry Software OÜ, the Estonian company behind GoldenBerry Studio. They apply to goldenberry.studio and to GoldenBerry Studio apps, including Pace, PhotoGlide, Misool Divesite Manager, and Cortex, unless an app publishes its own terms that say otherwise. By using our sites and apps, you agree to them.

Who can use them

You need to be at least 13 years old, or the minimum age of digital consent where you live, whichever is higher. If you use our products for an organization, you're agreeing to these terms on its behalf too.

Using our products

You may use our products only as permitted by law and by these terms. Don't abuse them, break them on purpose, use them to harm others, or try to access data that isn't yours.

Your account

Where a product has accounts, you're responsible for what happens under yours. Keep your credentials safe and tell us right away if you think someone else is using your account.

Your content

Content you create or upload stays yours. You give us the license we need to store, process, and display it so the product can work, and nothing more. If you delete it, that license ends, subject to short-lived backups.

AI outputs

Some products generate content with AI (captions, drafts, suggestions). You're responsible for reviewing AI output before you rely on it or publish it. We don't guarantee it's accurate, original, or fit for a particular purpose.

Open source

Some of our work, like Pace, is open source. The license in each repository governs that code, and where it conflicts with these terms for that code, the repository license wins.

Purchases

Purchases made through the Apple App Store or Google Play are billed and refunded by that store under its own terms. When you buy directly from us, we mean what our principles say: pay-once purchases are yours, and if something we sold you is broken, email us and we'll make it right.

Warranties and liability

Our products are provided "as is". To the extent the law allows, we disclaim implied warranties and our total liability for any claim is limited to what you paid us for the product in the 12 months before the claim. Nothing here limits liability that can't legally be limited.

Ending or changing things

We can change or discontinue products, and we can update these terms. If a change to the terms matters, we'll update the date above and flag it in the affected products. If you keep using a product after that, the new terms apply. We can suspend or close accounts that break these terms or abuse the service, and where it's reasonable we'll warn you first.

Governing law

These terms are governed by the laws of Estonia, where GoldenBerry Software OÜ is registered, and disputes go to the Estonian courts. If the consumer law where you live gives you rights these terms can't take away, you keep them.
